Remember i got a new Transit a few months back,well tonight i have scraped it down the passenger side
In my defence I was parked up down a back alleyway servicing a pub,when i came to leave a car had parked half on the road half on the pavement and to make it more difficult the alleyway had a dogleg in it
Anyway there i was looking down at the side of the drivers side with just a inch to spare next thing that horrible noise as metal scrapes along the wall on the other side
i caught the wall at the dogleg,scraped and dented the side door and rear panel,
not looking forward to ringing my boss Monday as the company has a policy of the drivers pay the insurance excess which is £500

Awful when you do things like that. Lady M parked in a bay, squeezed past with her wheelchair but forgot that the electric sliding door moves out when it opens! She'll find out about the metallic repaint job soon,

I doubt whether it's legal or enforceable (although if Canny refuses to pay, he can probably kiss his job goodbye) Last company I worked for sent me to Bristol to deliver some shop fitting stuff. Whilst driving down a street with cars parked either side, I inadvertently managed to hit a parked car. Just happened to be a 6 month old Merc, and ended up needing a new wing, headlight and a touch up with paint. Total cost to the company was around £1400. The transport manager told me, the most they'd ever paid out was when an employee managed to hit a brand new Ford Mondeo, with a 7,1/2 tonner, writing the Mondeo off. Rather than go through the insurance, they bought the accident victim a brand new Mondeo (of his choice) Apparently the increase in premiums would have been more than buying a new car. (company had 2 lorries and hired more as and when they needed them, but on their insurance, which cost an absolute fortune in premiums)

I was at work at the time,I rang another engineer today as he had an accident last year,he was to blame hit a new car up the rear,the company deducted the £500 excess from his wages

terms and conditions off employment will cover this point
if they have been altered or amended unless you or your representative acting directly under your or your group interest have agreed the alterations will not apply so not enforceable

This isn't legally enforceable as their own insurance would cover it and you shouldn't have to pay anything as you are on their company insurance.

The problem lies with your relationship with the company. Do you have a contract with the company and if so how long? If you only have a short term contract with them they probably won't renew it. If you have a full time contract with them tell them you aren't obliged to pay anything.

Keep all correspondence with them and if possible take a union rep or friend with you to any meeting.

I'd speak to the your local CAB office for further advice.

I simply wouldn't work for a company that used this form of 'blackmail'. If you're liable in any way then you should be able to do anything you like with their vehicle - including private use etc.

One of the tipping points for me walking out on my last employer (10 years ago now and only one of many reasons ) was their insistence that my company car had a GPS tracker fitted. 'For insurance purposes' they claimed...... yeah, funny how I couldn't do anything privately witout them knowing every move I maked though..... tw@ts.

Unless it states that the employer can stop this in your written contract of employment, then it's illegal for them to stop this money. Check your contract of employment carefully. Many employees, don't bother reading their contract in full, to their detriment.

From what I remember if it hasn't changed was, they can take the money but only with your permission, but I was always told that if you do say no, they can just make your life hell at work or just look for any reason to sack you.

How about looking at it this way.

The company insurance does not cover it, and the vehicle still has to be repaired, the person who damaged it will be asked to pay.

It may be a case of to claim on their insurance puts the premiums up too much, so its easier not to claim. Friend works for a company that the driver has to pay for any damage he causes, the insurance is only for 3rd party, so will not pay out in this case.

As for arguing / telling the company its not enforceable I agree with "feva" on that one
