It's law apparently. They tried to make it a year but employment law prevailed.
that out off order really just another way normal working people have there conditions eroded in the name off profit :roll:

Apologies Big Al it seems you were correct. My mate's T&C's are changing soon but he forget to tell me he accepted a 45K payment to agree to it. My other mate who works there didn't sign up to it and his T&C's remain the same indefinitely.

Hi folks, well still employed and only just, phased back in Sept16 and thought I would return to my normal duties, Wrong, they have kept me behind a desk since returning and I have been told I'm not allowed out until I come up to and prove i can work to the standards expected, even though the PIP and resultant investigation was thrown out they are judging me on the final comments of that investigation, I did object at the time that I didn't get to put my side of the story to justify certain aspects of my work falling behind because of an upsurge then in relation to a task no one else was qualified to do, but was advised by the investigator that I didn't need this as he had dismissed the investigation and I was back to square one. (sorry if I have already said this in another post) I have now been moved to another desk which is very uncomfortable and surrounded by line managers. They now want to put me on another 4 week PIP and I objected to this on the grounds of how they conducted themselves during the last one, that was nearly 2 weeks ago and no sign of it happen yet. They didn't as per policy give me a back to work meeting last year as one of the questions is 'was your condition caused by work' if answered 'yes' someone would have to investigate this so I'm going to request this happens, I came back looking for a clean slate and didn't want to upset the apple cart by going down the greivence route but have been made to feel continually uncomfortable and its obvious they want rid of me! The employment situation up here is dire due to the oil turn down, I'm now only 23 months from being retired and my health is yet again suffering. Seeing the doc today but need to stay at work if i can trigger an investigation.
Just hanging in there, one of my colleuges who was in the same situation as me has not received his investigation result and is allowed to work normally that is because his one will have collapsed as well but to save face they won't tell him, he was also off for about 2 months, I forced them to come up with mine hence the situation I am in.
That's the story so far but know I won't see the year out with these Barstewards!

If you feel under pressure due to their actions then resign - then take them to tribunal citing 'constructive dismissal'.

I was forced along that path years ago but knew little/nothing about this process until someone at the tribunal services told me to 'get a lawyer' - he recognised that I had a perfect case but was innocent in the methodology of progressing such on my own (although I was trying) and when I took a lawyer (one of those no win, no fee jobs) the company I left ended up floundering under questioning and lost their side of the argument big-time.

Compo was awarded and the lawyers made their own case for fees which didn't affect my outcome.

You could get compo and your pension rights, peace of mind and away from their 'subtle pressure'.

you can take them court under the equality act 2010 if you have a condition that has lasted more than 12 months or will effect your health for life

If you can prove your protected status - They have a duty of due regard and must treat you fairly and comply with the prohibited conduct guidelines

if you employer is in public sector or a contracted organisation you have a few more powers

Hi there, we are an organisation and our funding comes mainly from the the local authority, funny enough we have been in the Sunday Times top 100 org's to work for 3 years in a row! and this is judged by employee's filling out online questionaires, a number of people at work are wondering who is filling out these!

Well its all quiet on PIP front for me but my colleague is getting a disaplinery hearing on Thursday for absence from work and they haven't fed back to him about his Investigation last year same as me which forced him into illness! and they insist that everyone one is treated equally! The Doc upped my meds and I slept all night last night for the first time in I don't know when, except when I have had a drink or two, even slept in today! hope for the same tonight.

Well, having 2 weeks off work with a bloody bad strain I'm off back to work tomorrow, I will be asked to attend a back to work meeting but I will be asking that this be done by email so I can request a 'back to work meeting' which I was denied last year when I could claim my condition was caused by work! I was willing to let all the sh*t go but these bastards are not, so I will request my back to work meeting for last year which will start an investigation as to what happened then and if not, sh*t hits the fan, because they have to do something! Unite, my union have called for a meeting to set up a branch for 'not for profit' organisations! don't think I have been served well by rep, after speaking to a shop steward from another org, he wasn't confident with who my rep was! should follow this up as I think I could make a difference but could I be bothered with little time to go! Yes I could! health is not good but don't agree with how people in our organisation are being treated.
2 weeks off and trying to go back fresh and not wanted by the barstewards! 26 yrs helping the fuel poor and it comes down to this, i have always entered clients homes and done everything I could to help them, I'm not a saint but when I can help someone I do what i can, without prejiduce! but level is being threateaned.

It's an easy thing to advise the guy to resign when it doesn't affect any of us in the slightest. I've been in a similar situation when I worked in the Prison Service but I had the advantage I could transfer which I did.

If a manager has it in for you there's not much you can do except log absolutely everything in a diary noting how it made you feel etc.

I do know it can be very stressful and it can overspill in to your private life.

My situation started when a manager lost the plot and punched an inmate. I didn't agree with what he done and wouldn't back him up with a concocted story nor would I grass him up. When I refused to make a statement it was kind of obvious to the investigating officers that something untoward must have happened.

I transferred prisons but the tw*ts held me back for 6 months stating they had a shortage of staff. They messed me around for those 6 months but I could see a light at the end of the tunnel. I think they wanted me to blow my top but I didn’t.

My advice to you is hang in for those 23 months. It will pass before you know it. Just don't give them any rope to hang yourself.

I have 2 investigations this week one I should breeze but the other has got me worried, I made to boobs at work last week ans it might be enough for them to get rid of me, the one that worries me is today, just have to front up and plead my case, not sure but it's at least one warning but they could make it two and that could be dust for me, just about had enough of the place anyway but 58 yrs old and too many people chasing jobs up here it looks bleak, might know at the end of the day.

Hi there, it was nervous day, but the meeting I think went well, even though I was not aware that if I was waiting for a personal call i had to inform a line manager, on the day in question I didn't have a line manager to advise of this due to illness and holidays, there was one guy who was my line manager in the past but due to illness he had been relieved of any manger duties and it was him who instigated the investigation against me, vital point i think, was able to high light how I was treated last year not being allowed to resume my normal duty's. When one of my co workers was able to get back to his in similar circumstances and with no feedback in relation to his investigation. I don't think I'll loose my job worst case senario will be a warning but I'm looking for no further action due to procedural failings. Bottom line is I need to get out of here for the sake of my health and my wife, I'm only still there for the pension I don't give a dam about who I serve now but if I get back to help the people I have served in the past I know I will resort to wanting to help people, 22 months and counting! been there 26 yrs and went through a lot of Sh*t and still dealing with it!

Well< I'm looking at a warning at least it hasn't been dealt yet but coming this week, my wife is exhausted from all my sh*t and what has she has been dealing with her parents but getting there.

Look! honest! is somebody taking the p*ss as I still can't see this effing button!.... right, I've been had!
