Breach of DPC by Neighbour.....What Action can I take???

Hi All
On 30 May this year my garage developed an 'internal river' following a massive downpour the night before. On investigating I discovered the neighbour the other side of the wall has at some stage landscaped his garden with decking and has banked up dirt and shingle against the wall breaching the garage dpc by approx 3 coarses!
Funnily enough he said it's not his fault!! I claimed via my insurance but they won't pursue him to do the remedial work.
Following more rain it flooded again last night and I went round to see the neighbour again. He refuses to do anything other than via the insurance.
Naturally it's making me v.angry as we are waiting to rubber paint the floor and use the garage as a garage not a duck pond.
Can anyone advise the best course of action can I take please.
