Yesterday a company (e2save, a subsidiary or carphone warehouse) cold called my wife about the mobile upgrade she was due and proceeded to try and sell her a new contract etc etc. She advised the sales rep that he should contact the main account holder (me!!) to check that this is ok.

So, here's the rub: He told my wife that they had already contacted me!!!!!

This was a complete lie, but on the back of this information my wife proceeded with the upgrade deal. I have now, finally, managed to complete the cancelling of this thieving company's contract, although they are curiously only open 9 to 6 during weekdays at 10p per minute plus standard network charge (and they love putting you on hold), and have had to re-register my wife's existing sim card with Orange since e2save had the old one deactivated as part of the sale.

All in all, a completely unscrupulous company who are prepared to lie, deceive and cheat in order to make a sale but are unwilling to even apologise for their misdemeanour yet alone offer compensation for the phone calls, time, inconvenience and hurt caused.

I have already lodged my complaint with Orange regarding this company and will contact Carphone warehouse. In the meantime, please be aware that this is a company that you do business with at extreme peril.

The bloke from Orange suggested the same and I'll get onto it. In the meantime he told me that if I wanted to prevent Orange from passing my account information onto third parties that this needs to be requested in writing (preferably as an email) since the default preference is to allow this sort of shenanegans to go on (it'll be somewhere deep in the fine print of the contract you agree to).

You may wish to consider doing the same thing to prevent other companies from contacting you.

There's a Law about having to Opt out.

All the rage these days, a "free upgrade" that costs you ££££s.
I should be dead; I've cheated the Grim Reaper yet again by surviving my third heart attack in June.

Don't do it Dextrous. Giving them your full name address and mobile number will land you with countless phone calls asking about "your Upgrade" etc and start it all over again. :wink: :wink: :wink: :wink: :wink:

Agreed, far better to tell them and Orange where to go with their sh*t service. :angryfire:

I think the way the OP's wife was contacted and supplied blatent lies is inexcusable, no company should be able to get away with that even if it is just a rogue telesales employee trying to bust up to the next commision level.

My girlfriend wrote to the company secretary of Carphone Warehouse, Andrew Sunderland, on February the 6th because the same thing happened to her.

What concerns me is that, not only did he fail to respond, but it would appear that he has failed to stamp out the practice.

I was working away at the time, we live in a very rough neighbourhood and have two young children. She was without a working phone for three days because e2save attempted to fraudulently benefit from this mis-selling.

I am glad that you have offered to sort out the problem for the person concerned here. Perhaps you could also discuss the fiduciary duties of directors with Andrew Sunderland. I am amazed that someone who trained at a prestigious law firm such as Olswang can allow this practice to continue under his nose.

OFCOM only monitor this issue in case it becomes widespread. They do not handle individual complaints of which I am starting to think there are tens of thousands.

Hi all

Sorry, I've not been on here for a couple of weeks and thought that this thread might have come to a conclusion and fizzled out. So, here's where we're at:

1/ I have complained to Ofcom who have replied to me and advised me that based on what I have told them, e2save have been guilty of mis-selling. They also told me that I was right to report this issue to them as well as complain to Orange.

2/. I have complained via email to Orange (after advice from one of their employees who also advised me that e2save were guilty of potential fraud and deception and of damaging Orange's reputation) and insisted that my details are never to be passed on to any third parties whatsoever under any circumstances. I got an email back from them which suggested that some half wit hadn't read my complaint properly, but my reply to this - suggesting that they re-read my complaint and stopped fobbing me off with platitudes and instead actually actioned my request has led to being contacted by someone and I have had my request for privacy approved and acted upon.

3/. I have also written to BBC's Watchdog so that they may continue to build up their possibly growing portfolio, should they wish to investigate.

4/. I have drafted out a letter to the Carphone warehouse which I have sat on for a few days since, curiously, my internet speed Orange are the ISP) had dropped dramatically at exactly the same time that this company stuck it's nose into my business. As it happens, after several hours and numerous phonecalls to Orange and BT(who provide the landline) trying to sort it out, it would appear that this was due to my Skybox. It was a very strange coincidence, and I needed to verify the cause in case this meddling around with my Orange account had caused some other effect on my Orange Broadband account. e2save doesn't appear to have an email address, and Carphonewarehouse requires one to provide them with a customer number before you can send them an email on their complaints form, which is rather stupid since the whole blooming point is that I am not and never will be a customer of theirs after this charade.


I will post the letter to Andrew Sunderland and attach a copy to this "Sarah", but will not provide with my phone number for obvious reasons. From now on, any contact they make must be in writing, either in electronic or hardcopy format to assist with potential legal action should this option become necessary. So without providing too much information, my requests include guaranteed privacy, an apology and recompense for my time, hurt and expenses.

I will forward any progress as and when and if it happens.

Amazingly, even though I was assured from the unpleasant and very slow speaking (at 10 pence per minute) customer services lady I spoke to at e2save when I was cancelling the account on Friday 17th that our details would have a "do not contact for marketing purposes", carphone warehouse has just phoned up my wife today and tried exactly the same selling technique.

I suppose that they will claim that e2save and Carphonewarehouse are different companies, but they presumably have access to the same database with that "do no contact" note on it, since Orange have since blocked any access to my records from a third party.

This is starting to look like harrassment.
